PURCHASES: As a condition to completing any purchase(s) on www.markeybear.com, you agree to the terms and conditions (the “Terms”) outlined below. These Terms constitute a binding agreement between you and Markey Bear Events, LLC (also known as Markey Bear Events). By proceeding with any purchase(s), you affirm that you have reviewed and consent to abide by these terms and conditions. If you do not wish to accept these terms, please refrain from completing your purchase.

REFUNDS: We appreciate any purchases or any consideration(s) to purchase. All event packages or Digital Content offered by Markey Bear Events are considered final and are non-returnable and non-refundable. At present, our event packages and Digital Content are exclusively available to customers located within the United States. Please contact Markey Bear Events for any questions, concerns, technical support, or any other matter regarding your purchase(s). 

AGE REQUIREMENT: By purchasing our event packages or products, or by participating in our events, or by browsing our website, you affirm that you are at least 18 years of age or older, and possess the legal capacity to enter into and comply with these Terms.

WINNER SELECTION: Participants are welcome to engage in multiple events hosted by Markey Bear Events. However, each participant is eligible to win only once within a particular series of events. For example, if an individual participates in both events within the “2025 Prize Giveaway Two #1 of 3 and #2 0f 3 and #3 of 3” series, that individual may be declared the winner of one event, such as the “2025 Prize Giveaway Two #1 of 3.” In this case, the individual cannot be selected as the winner for any other event within the same series, namely the “2025 Prize Giveaway Two #2 of 2 and #3 of 3.” Similarly, if the individual participates in the “2025 Prize Giveaway Four #1 of 3 and #2 of 3 and #3 of 3” events, that individual may win only once, such as the “2025 Prize Giveaway Four #2 of 3,” but cannot win any other event within the same series such as the “2025 Prize Giveaway Four #1 of 3 and #3 of 3.”

The winner must take a picture of themselves with the prizes. Failure to do so will result in not being able to participate in future events. 

 

CANCELLATION OF THE EVENT: If Markey Bear Events cancels the Event or due to circumstances beyond the reasonable control of Markey Bear Events that shall include, but shall not be limited to, fire; casualty; flood; epidemic; earthquake; explosion or accident; blockade embargo; inclement weather; government restraints; restraints or orders of civil defense or military authorities; acts of public enemy; riot or civil disturbance; strike; lockout, boycott or other labor disturbance; inability to secure sufficient labor; technical or other personnel failure; impairment or lack of adequate transportation facilities; inability to obtain, condemnation, requisition or commandeering of necessary supplies or equipment; local, state or federal laws, ordinances, rules orders, decrees, or regulations whether legislative, executive or judicial, and whether constitutional or unconstitutional; or Act of God, Markey Bear Events shall fully refund to each customer its payment previously paid. Markey Bear Events reserves the right to cancel, re-name or re-locate the Event or change the dates on which it is held. 

SHIPPING AND DELIVERY: Please note that unfortunately, we will be unable to modify or change the address once you have placed your order.  We also do not ship to P.O boxes. Once your prize or purchased items are shipped, we will send you a confirmation email with a tracking confirmation. Contact Markey Bear Events for any loss or damaged products.

LIMITATION ON LIABILITY: The customer agrees to indemnify, defend and hold harmless Markey Bear Events, the event host/store, the owner of such facility when we do a live in-person event, and the city and website in which an event is being held, and their respective officers, agents and employees, agents, licensees, contractors or customers, from and against all bodily and personal injury, loss, claims, or damage to any person or any property arising in any way. Markey Bear Events shall not be responsible for loss or damage to displays or goods belonging to customers, whether resulting from fire, storms, acts of God, air conditioning or heating failure, theft, pilferage, mysterious disappearance, bomb threats or other causes.

RESOLUTION OF DISPUTES: In the Event of a dispute or disagreement between: the customer and Markey Bear Events or between two or more customers; all interpretations of the rules governing the payment agreement, actions, or decisions concerning this dispute or disagreement by Markey Bear Events intended to resolve the dispute or disagreement shall be binding on the customer. 

AMENDMENT TO RULES: Any matters not specifically covered by the preceding rules shall be subject solely to the discretion of Markey Bear Events. Markey Bear Events shall have full power in the matter of interpretation, amendment and enforcement of all said rules and regulations, and any such amendments when made.

PHOTOGRAPHY/DISCLOSURE: The photographic rights for the events or items the customer have agreed to be reserved to Markey Bear Events. By paying the payment, the customer agrees to distribution outlined in payment agreement circumstances as well as liberal discretion of Markey Bear Events to utilize photography of their event presence for purposes as Markey Bear Events sees fit.
 

PRIVACY POLICY: At Markey Bear Events, LLC. ("Markey Bear Events”, "Company", “us”, “our”, or “we”), we value your privacy and the importance of safeguarding your data. We are committed to protecting your privacy in accordance with the highest level of privacy regulation. This policy applies to the Markey Bear Event’s websites, domains, applications, services, and products.

This Policy does not apply to third-party applications, websites, products, services or platforms that may be accessed through (non-Markey Bear Events) links that we may provide to you. These sites are owned and operated independently from us, and they have their own separate privacy and data collection practices. Any Personal Data that you provide to these websites will be governed by the third-party’s own privacy policy. We cannot accept liability for the actions or policies of these independent sites, and we are not responsible for the content or privacy practices of such sites.
